1. Introduction

Welcome to ahamin, a product operated by Amiflow Technologies Inc., a Canadian corporation. By accessing and using the ahamin platform, you agree to be bound by these Terms of Service.

ahamin is an online marketplace enabling merchants to create digital storefronts and promote their products to customers in Morocco and beyond.

2. Definitions

  • Platform: The ahamin website, mobile applications, and all associated services operated by Amiflow Technologies Inc.
  • Merchant: Any individual or legal entity registered on the platform to list and sell products.
  • User: Any person browsing or interacting with the platform.
  • Store: A merchant's virtual storefront on the ahamin platform.
  • Product: Any item or service offered for sale by a merchant through the platform.

3. Account Registration

To create a merchant account and use platform features, you must:

  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality and security of your login credentials
  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Use your account solely for lawful business purposes

4. Merchant Obligations

As a merchant on ahamin, you agree to:

  • Offer only legal products that comply with applicable laws
  • Provide accurate and truthful product information (descriptions, prices, images)
  • Honor your product listings and respect customer rights
  • Respond to customer inquiries in a timely and professional manner
  • Refrain from publishing offensive, discriminatory, fraudulent, or illegal content

5. Subscriptions and Payments

ahamin offers multiple subscription plans: Basic (free), Pro, Pro+. All prices are listed in Moroccan Dirhams (DH) and include applicable taxes.

Payments are securely processed through Stripe. Subscriptions automatically renew at the end of each billing period unless canceled.

Payment failures trigger a 7-day grace period before account downgrade. You may cancel your subscription anytime from your billing dashboard.

Refunds and Chargebacks

  • Refunds: Only the initial first payment for a plan subscription and the initial first payment for a website subscription are eligible for a refund. Renewals, upgrades, and subsequent subscriptions are non-refundable.
  • Domains: Domain purchases and registrar-backed custom domains are never refundable due to their non-reversible nature.
  • Chargebacks: Initiating an unauthorized chargeback may result in immediate account suspension. Contact support to resolve billing disputes.

6. Prohibited Content and Conduct

The following are strictly prohibited on ahamin:

  • Counterfeit, stolen, or illegally obtained products
  • Illegal substances, weapons, or controlled items
  • Pornographic, violent, or otherwise offensive content
  • Products that infringe intellectual property rights
  • Discriminatory, hateful, or harassing content or behavior

7. Intellectual Property

All platform content, including the ahamin brand, logo, design, and proprietary features, is owned by Amiflow Technologies Inc. and protected by intellectual property laws.

Merchants retain ownership of their content (product images, descriptions) but grant ahamin a non-exclusive, worldwide license to display, reproduce, and distribute such content on the platform for operational purposes.

8. Limitation of Liability

ahamin acts as a marketplace intermediary and is not a party to transactions between merchants and customers. We are not responsible for disputes, product quality, delivery issues, or merchant conduct.

The platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure operation. To the fullest extent permitted by law, Amiflow Technologies Inc. disclaims all warranties, express or implied.

9. Account Termination

You may close your account at any time through your settings. Amiflow Technologies Inc. reserves the right to suspend or terminate accounts that violate these Terms of Service or engage in fraudulent or harmful activity.

Upon account termination, your personal data will be retained for 30 days to allow for recovery, after which it will be permanently deleted, except where legal retention obligations apply.

10. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

Any disputes arising from these terms or your use of ahamin shall be resolved exclusively in the courts of Ontario, Canada. If you are a consumer in Morocco, you retain any mandatory consumer protection rights under Moroccan law.
